Çevrenin kirletilmesinden doğan Hukuki sorumluluk

Bu tebliğ ile Çevre Kanunu çerçevesinde getirilmiş olan çevrenin kirletilmesinden doğan sorumluluk incelenmektedir. Bir kusursuz sorumluluk hâli olarak getirilen düzenlemenin, medenî hukuk açısından sonuçları değerlendirilmektedir. Öncelikle sorumluluğun niteliği konusundaki tartışmalara değinilmiş ve bu konudaki görüşümüz açıklanmıştır. Daha sonra, sorumluluğun koşulları açıklanmaktadır. Sorumluluğun koşulları olarak, sorumluluğu doğuran olay, zarar ve olayla zarar arasındaki illiyet bağı incelenmektedir. Sorumluluğun doğumundan sonra talebin bağlı olduğu zamanaşımı değerlendirilmektedir. Ayrıca çevreden doğan sorumluluk, diğer sorumluluk hallerinin yarışıp yarışmadığı hususu değerlendirilerek, yarışmanın varlığı hâlinde sonuçlar incelenmektedir.

In this article analyses the liability arising from the pollution of the environment. The results of this liability, which is regulated as an objective liability are evaluated in terms of civil law. First of all, the arguments about the nature of the liability are mentioned, then the author's opinion about the subject is revealed. The conditions that are required for the liability are discussed. The conditions of the liability, the event that causes the pollution, damage and the causal relation between the event and the damage, are examined. Besides these, it is questioned whether some of the other types of liability compete with the liability arising from the pollution of the environment and, if they compete, which one is more advantageous for the aggrieved party.
