Ceza muhakemesi hukukunda hâkimin yasaklılığı, reddi ve çekinmesi kurumu adil yargılama yapmak suretiyle maddi gerçeğe ulaşılabilmesinde önemli bir rol oynamaktadır. Nitekim adil yargılama yükümlülüğü olan hâkimin tarafsız olması gerekir. Tarafsızlık hâkimin önüne gelen davada taraflara eşit mesafede durabilmesi ve bunu görüntü olarak sergileyebilmesidir. The aim of this thesis is to propose a hypothetical community for queer people of 20th century England depicted in two novels: Radclyffe Hall’s The Well of Loneliness (1928) and Jeanette Winterson’s Oranges Are Not the Only Fruit (1985) through Agamben’s idea of community.
